This post is made as half-joke but genuine curiosity is... if Hermes is being sued like this... couldn't Rolex also face the same fate of being sued? Forget successfully winning/losing/defending for a moment... crazy times!!

This will not make it to trial and it will back fire on the plaintiffs; One, they will never get the bag from Hermes, and two; Hermes in turn gets cheap marketing.
Three, Hermes can justify increasing prices to offset inconvenience legal costs
I think the problem is that no such alleged tying of bags to other purchases actually happens in any explicit form. In reality it's likely much worse, they make you buy crap you don't want but refuse to bundle it with the thing you do want and instead all you get is a "maybe", in other words... you get nothing.
Effectively their staff just looks like they're really good at selling things 😄
Also, rolex is a bit more subtle in that they have 'The waiting list' for punters who aren't on brand to sell to, while Hermes SAs seem to have just come out and said that it's pay-to-play
