Rolex side of Oyster and Pop

Oyster & Pop sell a collection of colourful wall clocks and charts designed to help children learn to tell the time - which retail at about £20. The company was set up by sisters Emma Ross-McNairn and Sarah Davies and is named after Oyster Bend in Torbay, Devon - where they grew up. But lawyers for the eight-billion dollar company Rolex wrote to Oyster & Pop in early January to demand they rebrand.

The rest of the story not in the news:

This two year old company that has not gone through the trademark process.  They would likely have been denied based on their application of use.  It is disingenious of the news not to mention the application and this is why Rolex took exception to brand dilutiion.  I understand if they *women of devon) had been doing this for 20 years and Rolex suddenly took exception, however this is just a 18 month old application. (filed in 2021 -03-09)

Their application of trademark use:

Primary US Classes

  • 002: Receptacles
  • 027: Horological Instruments
  • 028: Jewelry and Precious-metal Ware
  • 050: Merchandise Not Otherwise Classified

Primary International Class

  • 014 - Primary Class
  • (Jewelry) Precious metals and their alloys and goods in precious metals or coated therewith, not included in other classes; jewelry, precious stones; horological and chronometric instruments.

Rolex was doing what is reasonable and timely at this juncture.  Not so much a david and golith story.   Just two ladies thinking they could get cute with a name, file trademark, make it a news story and get away with it.  

Rolex is actually being nice at this point in time.  Saving them money on further hassle with their trademark case which they would likely lose in the long run.

Haven’t seem a picture of their clocks yet but if this is one, and they all have that crown, no wonder Rolex is upset. I wondered if they had a case, they originated in Oyster something or other (location), but seeing the crown changed everything.

I agree with you that there are 2 sides to every story, and both should be carefully considered. However, I think the proper picture of Oyster & Pop's products should be shown instead of something else that may be mistaken as O&P's product, particularly when the representation shown above has a crown, which O&P does not.
