JomaShop Did Not Return My Watch From Service

UPDATE 8/31/22: As JomaShop was unresponsive via email, I filed a BBB complaint. Shortly a representative from JomaShop called.

I was forceful and demanded the watch be returned. It was, repaired, in a poly bag with a sticker that had the watch reference number and an $895 price tag.

I purchased a Tissot V8 automatic chronograph watch from JomaShop. Instead of repairing the watch, they issued store credit without returning it. They deemed the watch irreparable.

I'm dissatisfied as the cost of the watch has gone up over the past two years.

Anyone had experience resolving this kind of conflict with a gray market service provider? This is the second time I received the irreparable lesson.

Also has anyone had recent experience with JomaShop and has a contact that's higher up the food chain? Thoughts on what to do? Cheers.

Man that sucks. I've bought watches from jomashop before but I don't dare buy something over 100 bucks from them. Good luck with that!

Wow can’t believe that a big company like that could be so bad. I will avoid them like the plague from now on.

This watch was almost two years old, so no.

Brick and mortar. You'd never have this problem buying from an AD.

You wore a Tissot for two years and got all your money back towards a new watch.  That’s a deal I would make every day of the week.  Jus’ sayin’.

Hello,

We don't get no credit, the watch was defective our vendor does not give us any type of refund for a defective unit, Unfortunately that's not how it works. Our return policy clearly states its 30 days for a refund. Unfortunately no you don't get the watch back but we have issued a credit. If you have any further concerns you can call in and speak to a manager. I have informed you of the the credit and how you can use.

Heidi,

I went to Jomashop's website to read the warranty. There is no language on that page that states any of the policies that Jomashop has taken.

Please send me a link to Jomashop's website that describes the scenario we are in right now: I do not get my watch back and I get only store credit, not a cash refund, for this.

It seems that Jomashop has sold this watch to another party, received income from that, and then has only given me cash back.

The warranty clearly states that this is a service warranty. In other areas of service, such as car repair, the repair shop is obligated to return defective parts.

I just don't understand why this is considered outstanding customer service. If I had known Jomashop had done this, I would have paid for independent watch service.

I am not satisfied with this outcome. Again, I request that Jomashop provide documentation that I agreed to this policy at the time of sale. Cheers.

Sue them for conversion.  They have no right to confiscate your property, even if they do issue you store credit.

Don't forget their watches are already discounted and you got your money back in store credit. Your out nothing for 2 years of wear. You will not find better prices on a Tissot.

The watch is 329 on Jomashop ( if this is the same watch). Personally I would not be too upset 4 bucks + tax out of pocket for a new watch not too shabby in my opinion.

Use the store credit and write them off!  I wouldn't continue to conduct business with a company that would even dare pull a stunt like this.  It's not worth getting really upset over either.

What about this…you bought a Rolex for $8k a few years back and it’s now worth about $11k.  You send it to Rolex and they tell you you can’t have it back as it’s unrepairable, but here’s an $8k credit.  They then turn around and resell your watch for $11k. As a bonus, they don’t have any watches you can buy for $8k.  

Kind of far fetched, but it’s the kind of thing a company could do if it’s legal to not give your property back at your request.

But that’s not the point is it?  What if this watch has sentimental value?  Even if it doesn’t, that doesn’t matter. It’s his property, and he wants it back. Whatever his reasoning, unless they’re claiming the watch is as destroyed or lost, they are obligated to return it at his request.

It's not legal.  It's called conversion, and it's a crime.  It's also a civil cause of action.

"A conversion occurs when a person without authority or permission intentionally takes the personal property of another or deprives another of possession of personal property. It is a tort which allows the injured party to seek legal relief."

You can sue them in small claims court for the cost of a replacement in full, especially given what you have in writing.

I've not bought grey market yet. Most of the folks that do, from what I've read, do so with the understanding that the money they save needs to be enough to cover a service to the watch, should it be necessary, in which case, they break even. It's a bit of a gamble from what I understand. I've read repeatedly the warranty they offer means nothing and their "service department" are not the kind of folks I'd want working on my watch. I have doubts as to wether they actually have a real watch maker on staff. You either know this going in, or you didn't do your homework. A quick google search is all it takes. 

At this point, you really don't have an option. Try to find something they have in stock that you want and use the credit. If you like it and it needs service, find a reputable watch maker. If it's not in stock, don't order it. You could be waiting for months.

Crappy service at its worst.  They're based out of Brooklyn NY.  I grew in DT Manhattan.  Jewelry district at that time was on Bowery St. by Manhattan Bridge entrance.  No to horrible customer service and sleazy under handed business practices were common.  With the internet, it just got a wide victim base.  I bet you anything JamoShop can be traced back to the shady Bowery St. roots.

Got to agree with that. Trust me OP, from the outside looking in, this is hardly an end of the world situation, or even a particularly bad outcome all told. You can do a lot worse in the world of watches.
